NC energy bill would give Duke Energy big wins on regulation - Charlotte Business Journal
Duke Energy Corp. would achieve many of its most-sought regulatory reforms, business plan writer charlotte nc, including multiyear rate plans and performance incentives that could increase its revenue, under legislation proposed Tuesday in the N. General Assembly. The bill is also notable for what is not in it. There are no provisions for a proposed study of structured, more competitive markets — such as regional transmission organizations and independent systems operators — which Duke has strongly opposed.
Martin was part of the stakeholder group made up of Duke, industrial and manufacturing interests, solar industry representatives and the N. Sustainable Energy Association that the General Assembly convened to help shape the long-anticipated energy legislation, business plan writer charlotte nc.
Martin says it was a good process, with everyone allowed to state their proposals and concerns. But he is not happy with the final product. He said North Carolina is missing an opportunity to consider market reforms that would save customers money and produce electricity more efficiently.
Spokeswoman Grace Rountree says Duke is still reviewing the version of the bill presented Tuesday. But she also said the company supported many of the specific provisions she was asked about. The bill packs a lot of energy legislation in its 47 pages. And it exempts Duke from a maximum size of 80 megawatts for new projects business plan writer charlotte nc is imposed on independent solar developers.
That business plan writer charlotte nc not increase the rate at which solar is acquired through the bidding process, with the bill mandating Duke seek bids for about megawatts annually. It calls for construction of battery or other energy storage systems at several of the retiring coal plant sites, and it mandates Duke own and operate any replacement power for the retired plants.
It mandates the Marshall Steam Station units 1 and 2 close in — one of the few clear concessions from Duke in the legislation. That is eight years earlier than Duke had planned. Any utility involved is instructed to attempt to get federal grants for as much of that as possible, but anything not covered by federal grants would eventually go on customer bills.
While there is much for Duke to like in the bill, the heart of what the company has been seeking is in the provisions to streamline the traditional rate-making process with what the business plan writer charlotte nc calls "performance-based regulation. It would allow utilities to ask the commission to set rates using an alternative to the cost-of-service model it now employs. That essentially requires utilities to request rate increases for plants and infrastructure that has already been built and is "used and useful" before it is put into customer rates.
The alternative would allow the utility to request multiyear rate plans that phase in established anticipated costs over three years. The commission would have oversight to make sure that the spending claimed by Duke in the second in the and third years are appropriate and justified. But there will not be a full review of rates as in the first year of the multiyear plan. The commission could accept or reject the multiyear plan, but it cannot require changes as it can under the traditional rate procedures.
The system would also build in performance incentives tied to public policy goals. These include more efficient energy production, energy savings, expansion of renewable energy and other established policies.
The utilities could increase their revenue business plan writer charlotte nc making the incentive goals, with the additional money coming from rate payers. If the company failed to meet the incentive requirements, business plan writer charlotte nc, they could be penalized, with additional money returned to customers. Critics worry this would allow for excess profits, and that, in some cases, utilities like Duke could benefit financially from improvements to their systems then get a second benefit from the higher incentive revenue.
Duke tried to get those reforms passed through the legislature in But the proposals were controversial then, as they are likely to be now, and the N.
House balked after the Senate approved the legislation. This bill comes out of the House, however, with top Republicans on the energy issue like Rep. Dean Arp of Union County and Rep. John Szoka of Cumberland county among thje principal sponsors.
But on a first reading, many critics raise alarms. That would be a red line for the Carolinas Clean Energy Business Association, says Executive Director Chris Carmodywho was involved in the stakeholder process. Business plan writer charlotte nc put out a release saying it will oppose the bill.
It raises questions about the plan to allow Duke to recover losses from early coal plant retirements and calls for the utilities to be to the same standards as independent solar developers.
